Official Promotion Rules 

 

By participating in the Promotion you understand any information you provide is managed by a US company and governed by US privacy policies.

There is NO PURCHASE NECESSARY to participate in the Promotion.

 

1) Promotion Description: Qittle, (the “Sponsor”) is offering “Live the Dream”, (the “Promotion”) and will determine a Grand Prize winner based on judging five (5) finalists (“Finalists) against the criteria identified in these Official Rules. The Sponsor’s intent is to determine a “Live the Dream” Grand Prize winner who will live in the Aspen/Snowmass community for a twelve (12) month period participating in community events, visiting restaurants, attending entertainment and sports venues and serving as a “communication advocate” for the Aspen/Snowmass community by sharing the experience by personal appearances, interviews, blog postings, and various social networking venues as determined by the Sponsor. 

There are three (3) phases to the Promotion. The first phase (“Sweepstakes Registration Phase”) is a random sweepstakes that begins at 6:00:00 AM US Mountain Time (“MT”) on January 1, 2010 and ends at 12:00:00 PM midnight MT on October 31, 2010 (“Sweepstakes Registration Period”). At the conclusion of the Sweepstakes Registration Period (100) one hundred entrants will be randomly selected to compete in the second phase of the Promotion (the “Contest Action Phase”). The Contest Action Phase begins at 6:00:00 AM MT November 7, 2010 and ends at 12:00:00 PM midnight MT on December 1st, 2010 (“Contest Action Period”) The Contest Action Phase is a skill contest in which competitors (“Action Competitors”) submit a video and develop a mobile networking database (collectively your “Contest Submission”) which will be judged against the criteria identified in these Official Rules. At the conclusion of the Contest Action Period, five (5) Action Competitors will be determined Finalists who will participate in the final phase of the promotion, (the “In Person Judging Phase”).  The In Person Judging Phase is a four-day event conducted December 9, 2010 through December 12, 2010 in Aspen/Snowmass, Colorado. On the evening of December 12, 2010, the Live the Dream Grand Prize winner will be announced.

2) Eligibility: Promotion is open to existing mobile phone subscribers, 21 years of age or older as of January 1, 2010 with proficient English language (written and verbal) skills, excluding residents of Cuba, Iran, Myanmar, N. Korea, Sudan, Syria, Belgium, Norway, Sweden, Quebec, Australia and Puerto Rico. Additionally, you must be able to relocate to Aspen/Snowmass, CO between December  25, 2010 and January 25, 2011 and reside in the community for a 12-month period if chosen as the Grand Prize winner. Employees, officers and representatives of Qittle, its subsidiaries and affiliated companies, advertising and promotion agencies, the Promotion Prize Providers and any company involved in the design, execution, production or judging of this promotion (collectively “Promotion Entities”) and members of their immediate families and those living in the same household of each are ineligible. Void in Cuba, Iran, Myanmar, N. Korea, Sudan, Syria, Belgium, Norway, Sweden, Quebec, Australia and Puerto Rico and anywhere prohibited or restricted by law.  

3) How to Participate in the Sweepstakes Registration Phase:  During the Sweepstakes Registration Period, eligible individuals can visit http://livethedreamaspensnowmass.com and complete the registration form with first and last name, e-mail address, mobile phone number, date of birth, and country of residence. You may optionally provide the additional information:  street address, city, state/province, zip/postal code, gender and information regarding how you heard about “Live the Dream”. You may elect to receive mobile Promotion updates, and/or subscribe to the e-mail list of the Sponsor and various Promotion Prize Providers; however electing to receive mobile updates and subscribing to any e-mail lists are not requirements to register, nor do they improve your chances of being selected. There is a limit of one (1) registration entry per person. Entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted email address. A potential winner may be required to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the e-mail address associated with the potentially winning entry. Entries generated by a script, macro or other automated means will be disqualified. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different/duplicitous email addresses, the use of a sweepstakes service, the use of multiple identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Entries that are incomplete, contain irregular or invalid information, or are corrupted are void and will not be accepted. Information collected from an entrant is used only for the purpose of the prize drawing and to notify winners, and will not be re-used, sold or shared in any manner by Promotion Entities unless entrant has elected to receive additional information and promotional material from the Promotion Entities. By entering the Promotion, you agree to all of the terms and conditions of Sponsor’s Privacy Policy, which is available at http://qittle.com/privacy_policy.html.

4) Weekly SWAG Giveaways – Beginning Friday, January 8, 2010 and concluding on Friday, May 28, 2010, a random drawing will be held every Friday of the Sweepstakes Registration Period to randomly select one (1) winner from all entries received by 12:00 noon MT of that Friday to receive that week’s “SWAG” Giveaway Prize, (“Weekly Prize”).  The Weekly Prize is an item or service provided by one (1) of the Promotion Prize Providers and the Approximate Retail Value (“ARV”) of the Weekly Prize ranges from $20 to $500 USD. There are a total of twenty-one (21) Weekly Prizes with the total ARV of all Weekly Prizes not to exceed $3,000 USD. Weekly Prize winners will be contacted by the mobile phone and/or e-mail address associated with their registration to communicate prize claim information, (“Prize Notification”). If a response is needed from the potential Weekly SWAG Giveaway winner in order to fulfill the Weekly Prize, potential Weekly Prize winner has five (5) days from Sponsor’s first Prize Notification to provide the requested information. Failure to comply with any of these requirements will result in disqualification and the Sponsor may chose to award the prize to an alternate.  Unclaimed prizes will not be awarded.    

5) Overall Winner Selection in the Sweepstakes Registration Phase: One hundred (100) Sweepstakes Registration Entrants will be randomly selected on or about November 1, 2010 to participate in Contest Action Phase of the Promotion, (“Action Competitors”). Potential Action Competitors will be notified by the e-mail address and mobile phone number associated with their entry on November 2, 2010 and must respond within forty-eight (48) hours with a reply e-mail which (a) confirms their intention to compete in the Contest Action Phase and (b) provides the following information in their confirming e-mail:  Complete first/last name, street address, city, state/province, zip/postal code, and an affirmation they meet all of the eligibility requirements described in Section 2 of these Official Rules. Failure to comply with these requirements including failure to respond within this time frame will result in disqualification. In the event of any disqualification(s), alternates will not be named and the actual final number of Action Competitors depends upon the number of disqualifications, if any. There is no monetary value or prize award of any kind associated with being selected or confirmed as an Action Competitor.  

6) Contest Submission Requirements for Confirmed Action Competitors: Your Contest Submission consists of the following two parts: 

(a) Video Submission:  The Sponsor is interested is seeing brief, wholly original and creative videos in which an Action Competitor communicates how he/she plans to take ACTION to “Live the Dream” and why he/she can make a great communication advocate for the Aspen/Snowmass lifestyle.  Your video should incorporate the acronym “ACTION” on these points:  A – Announce yourself; C – Create a new lifestyle; T – Take chances; I – Inspire; O – Outgoing; N – Network with friends and family to support your dream. Your Video Submission must comply with the following points:

  • You must include phrase “Live the Dream” in the title and the content of your Video.
  • Do not feature images of any person other than yourself in the Video. 
  • Your Video Submission must be no longer seven (7) minutes in length.
  • Identify yourself by your first name only.
  • Do not include images of any object, location or building with brand names or logos, other than the Aspen/Snowmass brand name or logo.
  • Your Video Submission must (a) be totally original, cannot be previously published or appear anywhere else and CANNOT contain any third party copyrighted material (including but not limited to music or artwork) or otherwise infringe on the intellectual, property or other rights of a third party; (b) must be suitable for general audiences (i.e., may not be obscene or indecent, including but not limited to nudity, pornography, violent or profane depictions) and (c) must not depict or in any way violate any law or regulation.
  • Your Video Submission must not depict Aspen/Snowmass, the State of Colorado or the United States negatively.  Any Video Submission deemed negative will be removed from public view and will be disqualified.

In Sponsor’s sole opinion, Video Submissions, which do no meet any of these requirements, will be disqualified. Any Video Submissions, which do not meet standards published by YouTube at www.YouTube.com will be disqualified and/or removed from the site.

Once completed, visit http://www.youtube.com and follow the instructions to upload your video during the Contest Action Period. By submitting your video, you agree to the rules and regulations of this Promotion and the rules and regulations of YouTube. Additionally, you understand your Video Submission, will be posted on the YouTube public website; additionally you are giving the Sponsor the right to post your Video Submission on its website and/or public websites where it maintains accounts and you are assigning all ownership and usage rights to your Video Submission to the Sponsor in exchange for no compensation of any kind. All Video Submissions must be completed by 12:00:00 PM midnight MT on November 30, 2010. If Sponsor is duly notified that any element of an entrant’s Video Production infringes upon the rights of another person and/or receives a legally valid request to remove or invalidate the affected Video Submission because of such infringement, such Video Submission may be removed and disqualified from the Contest, as Sponsor may determine in its sole discretion.

(b) Mobile Networking Database: Each Action Competitors will be given a FREE Qittle account for the purpose of creating their personal mobile database. Action Competitors should use any plausible venue (i.e. Facebook, YouTube, Twitter, etc.) to drive traffic to their mobile account and build their mobile subscriber base. The size of each Action Competitor’s mobile subscriber base will be documented as of 12:00:00 PM midnight MT on November 30, 2010 for consideration in judging. Action Competitors must comply with Qittle’s mobile marketing best practices and the regulations of the Mobile Marketing Association in the use of their Qittle account.   

7) Judging and Finalist Determination: Contest Submissions will be reviewed by a panel of Qittle professionals and Aspen/Snowmass community leaders and will be judged and weighted equally on the following points:  (a) most original, articulate, genuine and enthusiastic content; (b) relevance of content with the ACTION theme (c) greatest inspiration to the Aspen/Snowmass community, and (d) size/scope of the Action Competitor’s mobile networking database. The judging panel will determine five (5) Finalists who will compete in the final In-Person Judging Phase of the Promotion. In Sponsor’s sole determination if an inadequate number of Contest Submissions or Contest Submissions of inadequate quality are received, it reserves the right NOT to determine any Finalists or to determine any number of Finalists fewer than five (5) to participate in the In-Person Judging Phase of the Promotion. The decisions of the judging panel in all matters relating to this Promotion are final and binding. Judging will be completed on or about December 5, 2010 and potential Finalists will be notified by phone and e-mail (“Notification”) the same day judging is completed and provided with an Affidavit of Eligibility and a Liability/Publicity Release (“Affidavit”) which must be completed and returned within two (2) days of Sponsor’s first Notification. Potential Finalist will also be required to send a copy of his/her passport, driver’s license, birth certificate or other appropriate documentation (acceptable to Sponsors) as proof of age and residency. Failure to return the Affidavit according to the deadline or non-compliance with any of these requirements will result in disqualification and the Sponsor will have the option of selecting an alternate Finalist.

8) Finalist Prize – Each individual confirmed as a Finalist will receive a trip to Aspen/Snowmass, CO to participate in the In-Person Judging Phase of the Promotion, (“Aspen/Snowmass Trip Prize”). The Aspen/Snowmass Trip prize includes roundtrip airfare for the Finalist to/from the major metropolitan airport nearest the Finalist’s home and Aspen, CO, with a departure date of December 9, 2010 and a return of December 13, 2010, four (4) night standard hotel accommodation, and transportation to/from various activities planned by the Sponsor during the duration of the stay in Aspen/Snowmass, Approximate Retail Value (“ARV”) $2,500 USD.  Any costs associated with prize acceptance and use not specified herein as being provided, is the winner’s sole responsibility. If travel arrangements have been booked/purchased and a Finalist cannot complete the Aspen/Snowmass Trip for any reason there is no compensation or reimbursement of any kind. If a Finalist is not a resident of the United States, he/she is solely responsible for obtaining a passport and any legal documentation needed for international travel.

9) In-Person Judging – During the period of December 9, 2010 and December 12, 2010, Finalists will participate in various formal and informal interviews with members of the Judging Panel and attend various social/entertainment functions as determined by the Sponsor. The Judging Panel will determine one (1) “Live the Dream” Grand Prize Winner (“Grand Prize Winner”) based on the content of the interviews and social interaction skills demonstrated by each of the Finalists in the planned activities. The decisions of the Judges in all matters related to the determination of the Grand Prize Winner are final and binding. The potential Grand Prize Winner will be announced December 12, 2010 Aspen. The potential Grand Prize winner is not the confirmed winner until the results of the background check are determined and approved by the Sponsor. Sponsor in its sole discretion reserves the right to disqualify the potential Grand Prize Winner for any findings it deems negative in the background check and name an alternate Grand Prize Winner.

10) “Live the Dream” Grand Prize: The Grand Prize Winner will receive the following: 

  • Relocation Allowance – A one-time payment by check of $2,000 USD. Grand Prize winner is responsible for scheduling and executing his/her relocation to Aspen/Snowmass, CO and the relocation should be completed no later than January 25, 2011.
  • Accommodations – Grand Prize winner will have the use of a furnished 1-bedroom condominium in Aspen/Snowmass for a 12-month period; monthly rent and utilities for the condominium are provided by the Sponsor.
  • Transportation – Grand Prize winner will have the use of a rental car, which includes gasoline and maintenance for a 12-month period, not to exceed $300 per month in total car rental expenses, which are provided by the Sponsor.  
  • Living Allowance – Grand Prize winner will have a pre-paid $200/week allowance for the 12-month period at a local grocery retailer of Sponsor’s choice.
  • Additional amenities/gratuities – Grand Prize winner will have FREE access to various venues, activities and events provided by various Promotion Prize Providers.

The total value of the “Live the Dream” Grand Prize (“Grand Prize”) is $75,000 USD. The Grand Prize Winner is solely responsible for any expenses not identified above including but not limited to: (a) Any and all expenses associated with living expenses for any other person he/she choosing to live with the Grand Prize Winner for the duration of the twelve 12-month period. (b) Insurance of any kind including but not limited to health, life, injury, personal property, theft, and automobile insurance. (c) Relocation expenses associated with returning to original residence at the end of the twelve (12) month period. (d) Phone (landline and mobile), fax and Internet accounts (e) Participation of any kind in events/venues not required/approved by the Sponsor.  If the Grand Prize Winner is not a legal US resident, he/she is solely responsible for determining and securing any applicable Visa or Green Card required for entrance, residence and employment in the United States. Failure to secure any such required documents before October 4, 2010 will result in disqualification and Sponsor reserves the right to select an alternate Grand Prize Winner.

11) Responsibilities of the Grand Prize Winner:

In exchange for the above prize/compensation, the Grand Prize Winner agrees to and is responsible for the following:

(a)      Hosting a weekly television and/or radio show on a local station whereby the winner will discuss his/her week in Aspen/Snowmass, interview local business owners, discuss people he/she has met, products/services used and events attended (collectively the “Aspen/Snowmass Experience”). Sponsor shall have final editing approval prior to the airing of any given segment.

(b)      Post weekly to a blog established by the Sponsor, writing about his/her Aspen/Snowmass Experience for the week. The content cannot contain any negative or inappropriate depiction of the Aspen/Snowmass community and is subject to editing by the Sponsor at any time.

(c)      Attend various local events as directed by the Sponsor at a minimum of one (1) event per week; additional events can be attended at the Grand Prize Winners discretion.

(d)      Maintain a social networking presence describing his/her Aspen/Snowmass Experience on Facebook and Twitter.

(e)      Travel as requested for any national partners to the Promotion; any such travel, if requested, will be scheduled and paid for by the partner to the Promotion.

12) Right to Terminate Winner / Sponsor Relationship:

Sponsor reserves the right to terminate its relationship with the Grand Prize Winner, including any unpaid expenses/prize items to the date of termination in the following events:

(a)       Grand Prize winner consistently fails to satisfactorily perform the responsibilities defined in Section (10) of these Official Rules.

(b)       Use of any illegal substance as defined under Colorado law.

(c)       Any criminal act as per the laws of the State of Colorado, whether or not convicted by the State

(d)       Fraud of any kind

(e)       Breach of accommodation arrangements

(f)        Disorderly behavior in a public area.

(g)       Any act or statement, which in Sponsor’s sole opinion, reflects negatively on the Sponsor, the community    of Aspen/Snowmass and/or any partner to the promotion.

Grand Prize winner has the right to terminate its relationship and forfeit any unpaid expenses/prize items to the date of termination in the event of the following:

(a)      Family illness or loss requiring his/her presence/attention.

(b)      Personal injury or illness.

13) General:  All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner(s). There are no prize substitution or options available. No prize recipient shall be permitted to replace his/her designated prize with another prize or item or redeem his/her prize or any portion of the prize for cash. All entrants agree to comply fully with each provision in these Official Rules. Any person attempting to defraud or in any way tamper with this Promotion and any person who does not comply with these Official Rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law. If, during either the entry period, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Promotion is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Promotion, without liability and to the extent feasible, will determine Action Competitors, Finalists and a Grand Prize Winner among entries received prior to cancellation or modification. Sponsor is not responsible for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. Entries or Contest Submissions, which are incomplete, inaccurate, irregular, or otherwise not in compliance with these Official Rules, are void.

14) Right to Use Your Work and Information About You: By submitting a Contest Submission, you: (a) represent and warrant that your Video Submission is wholly original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Video Submission does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) automatically grant to the Sponsor, a non-exclusive, world-wide, royalty free, irrevocable license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your Video Submission; (c) agree that upon selection as a winner of any prize, you agree that your Video Submission shall legally be considered a "work made for hire," with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of the Sponsor; (d) agree that upon selection as a winner of any prize, in the event your Entry is considered not to be a "work made for hire," you irrevocably assign to the Sponsor all right, title, and interest in and to your Video Submission (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade; and (f) agree that by submitting an entry, you grant to the Sponsor, the right to sell and otherwise distribute your Video Submission on any of its websites or in any of its advertising and/or products without any compensation. The rights granted under this paragraph shall extend to the Sponsor, its parent and affiliated companies with respect to all entries and all other submitted materials related to the Promotion, including those submitted by non-winners and winners.

By submitting a Contest Submission, you grant to the Sponsor, its parent and affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, the Video Submission in your Contest Submission and written or oral statements, for advertising and promotional purposes in promoting or publicizing the Sponsor, its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e‑mail address, biographical information, or entry. The rights granted under this paragraph shall extend to the Sponsor, its parent, and affiliated companies with respect to all entrants in the Promotion, including non-winners and winners. Sponsor, however, does not have any obligation to use the winning or non-winning Contest Submissions for any purpose. 

15) Release of Liability and Issues of Law: By participating in this Promotion you release the Sponsor, its parent, affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Promotion from any and all liability with respect to and in any way arising from participating in this Promotion, acceptance or use of prizes, including any and all portions of the Grand Prize. Entrants also agree that Sponsor, its parent, affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion are not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from the Promotion, the Entries and/or its prizes. The Sponsor reserves the right to modify or cancel the Promotion in the event that any portion of any website used to administer any aspect of the Promotion becomes technically corrupted.

All Federal, state and local laws and regulations are applicable. THE COLORADO COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF COLORADO SHALL GOVERN THE PROMOTION. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS. The Promotion is void where restricted or prohibited by law.

16) Information about the Finalists and the Grand Prize Winner:  The names of the five (5) Finalists and the Grand Prize Winner will be available at http://livethedreamaspensnowmass.com as it becomes available during the period of December 5th, 2010 through January 1st, 2011.
